Privacy Policy for Perfection Learning's Perfection Next Digital Delivery Platform.

This Privacy Policy (“Privacy Policy”) applies to information collected by Perfection Learning ("Perfection", "we" or "us"), on our site - Perfection Next, located at https://www.perfectionnext.com/privacy-policy.html - and its related mobile applications and educational services that post this Privacy Policy (collectively referred to herein as the "Site"). We are committed to preserving the privacy of those who visit the Site. This Privacy Policy will outline how we gather and utilize various sources of information obtained during your visit to the Site. This Privacy Policy applies solely to information collected on the Site. By using or accessing the Site, you signify your assent to this Privacy Policy. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY YOU MAY NOT ACCESS OR OTHERWISE USE THE SITE.

By using this Site, you represent and warrant that you are (i) located inside the U.S., or (ii) are located outside the EU and EEA and agree to be bound by U.S. laws. This Site is intended for users situated in the United States. We currently do not offer goods and services to the EU or EEA.

Information That We Collect

The Children’s Online Privacy Protection Act (“COPPA”) allows a school district or school to obtain consent for the online collection of personal information from children who are students of the school district or school. We have been retained by your school district ("District") and/or school ("School") to provide online educational services through the Site. Your District or School oversees the Site and, accordingly, has control over who can register for an account and who can use various features of the Site.

Districts and Schools are able to create and register administrative accounts ("Administrator Accounts") for their Districts/Schools and the administrators, employees and/or staff designated by each District/School (collectively, "Administrators"). Administrators will also be able to register additional accounts for their District/School teachers (collectively, "Teacher Accounts"), and their students ("Student Accounts"), and the parents of their students ("Parent Accounts"). Teachers in each District/School (collectively, "Teachers") may create their own Teacher Accounts for the Site and may be able to register Student Accounts and Parent Accounts for their students and the parents of their students.

In order to create or register for an account or utilize some of the services on the Site, you may be asked to provide, or you may choose to upload, certain information about yourself, your student(s) or their parents. With respect to all accounts, we do not collect any personal information that identifies you (“Personal Information”), such as full name or email address, unless it is voluntarily provided by you, a District/School, Administrator, or Teacher. Please note that we may, at the request of Districts and Schools, acquire certain Personal Information about you from a District's or School's service provider in order to create your account, authenticate login, and enable access to and use of the Site. We will treat such Personal Information in accordance with this Privacy Policy as though it were provided directly by you.

The following information may be collected when registering for and/or utilizing the Site:

  • Administrator Accounts: Information, including Personal Information, collected by the Site may include the first, middle and last name, email address, school name, username, password or other information provided by or associated with the Administrator Account holder.

  • Teacher Accounts: Information, including Personal Information, collected by the Site may include the first, middle and last name, email address, school name, username, password or other information provided by or associated with the Teacher Account holder.

  • Student Accounts: An Administrator or a Teacher may register a Student Account on behalf of his/her student and assign the Student Account a username and password. When registering the Student Account, the Site may collect the following information, including Personal Information, about the student: (i) student's first, middle and last name; (ii) student's ID; (iii) student's grade level; (iv) school name; (v) username; and (vi) password. Upon registration of a Student Account, the Administrator or Teacher will assign the Student Account a username, which the Administrator, Teacher or the student can change upon logging into the Site. Before a Student Account is created, Administrators and Teachers are given an opportunity to review and agree to the Terms & Conditions of the Site (a copy is located at https://www.perfectionnext.com/terms-and-conditions.hmtl). If they do not agree to the Terms & Conditions, they are not allowed to continue on the Site. The Administrator or Teacher is responsible for maintaining Student Account information. After registration, registered students will be able to access the Site by logging into the Site with the student's applicable username and password. The Site will allow students to communicate via the Site's internal message system with their Teachers and Administrators. Students will be able to submit assignments to their Teachers via the Site and their Teachers will be able to assign assignments and grades to their students via the Site. Each School is responsible for obtaining parental consent for its students to use the Site. If a parent has any questions regarding registration, please contact the child's Teacher or School Administrator.

Technical Data, Usage Data, Aggregate Information: In order to support the internal operations of the Site, we may also collect technical or Site usage information, such as IP host address, pages viewed, browser type, device type, duration and frequency of visits, and other data, and may aggregate any information collected in a manner which does not identify any individual ("Aggregate Information"). We collect this information solely to support the internal operations of the Site, including maintaining, securing, and analyzing the functioning of the Site, customizing content on the Site, and improving the performance of the Site. This information is not used for behaviorally advertising purposes and we do not permit behavioral advertising on our Site.

Use of Cookies: The Site may pass a "cookie" (a string of information that is sent by a web site to be resident on your system's hard drive, and/or temporarily in your computer's memory blocks). The purpose of a cookie is to tell the web server that you have returned to a particular page. The Site may use cookies to support the internal operations of the Site, such as allowing you access to password protected areas of the Site. You may set your browser to decline cookies. If you do so, however, you may not be able to fully experience some interactive features of the Site.

Please be advised that certain third parties that are beyond the scope of this Privacy Policy may collect information in connection with the Site. We are not responsible for the acts or omissions of such third parties. For example, we use Google Analytics to understand how visitors interact with our Site. The type of information collected includes pages visited and content viewed. This information helps us learn things like what pages are most attractive to our visitors and what kinds of content or products offers our users like to see. Information Usage

We will use the Personal Information that we collect from students solely for the use and benefit of the School, including providing the Site's educational services to its registered accounts. We do not use the Personal Information that we collect from students for commercial purposes not related to the provision of the services requested by the School.

From time to time, we may use the Personal Information that we collect from Teachers and Administrators to contact them for market research purposes, such as to invite them to participate in our focus groups and surveys. We may also use the Personal Information that we collect from Teachers and Administrators to notify them about certain enhancements, improvements, additions, and/or supplements to the products that they have previously purchased from us.

We do not use any information in connection with online behavioral advertising or building user profiles for commercial purposes. Nor do we sell any information to third parties or mass marketers.

Only we and our affiliates, our technical consultants, third party auditors and other third parties who make our Site available, enhance its functionality, or provide associated services and/or who deal with you in delivering content have access to this information, and we require them to agree that they are covered by this Privacy Policy.

Special Circumstances for Information Sharing

Please note that, though we make every effort to preserve your privacy, Perfection Learning reserves the right to and may disclose Personal Information about you in response to (a) requests from local, state or federal law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Site rules or policies, or the rights of third parties or to investigate any suspected conduct which we deem improper. Please also note that we do reserve the right to transfer your Personal Information and other information to our successors in business and purchasers of Site assets.

Children's Online Privacy

We are dedicated to the privacy of children, particularly children under 13 years of age. This Site is not intended for registration by children, including any children under the age of 13, and we have no intention of allowing children to register accounts for themselves for the Site. If a child under 13 has registered an account for him/herself on this Site, we will use all reasonable efforts to delete such information from our database. Please note, however, that there are sections of this Site that children may access without registration (including sections where children can play games and download materials) and we do not collect Personal Information from children on these sections of the Site.

If a parent or legal guardian would like to refuse to allow any further collection or use of their child's Personal Information, please contact your child's Teacher or School Administrator. If the request is made to us directly, we will direct you to your child's Teacher or School Administrator to validate the request and respond accordingly.

FERPA Compliance

We are dedicated to maintaining the privacy of all students, whether under 13 or older, in accordance with applicable laws. In this regard, we will maintain any and all Personal Information in education records which come into our possession in accordance with the requirements of the Family Educational Rights and Privacy Act ("FERPA"), and will not disclose such information to third parties except with the consent of a parent, the School or an eligible student (as applicable), unless otherwise permitted under FERPA and its associated regulations.

Links to Third Party Sites

Our Site may contain links to other web sites, including our affiliated or co-branded web sites. Other web sites may also reference or link to our Site. These "other" domains (web sites) are not controlled by Perfection Learning. We encourage our users to be aware when they leave our Site to read the privacy policies of each and every web site that collects personally identifiable information. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other web sites. Visiting these other web sites is at your own risk.

Security

Perfection Learning will not be liable for disclosures of your Personal Information due to errors in transmission or unauthorized acts of third parties. We have undertaken all commercially reasonable efforts to prevent unauthorized Internet access to visitor data retained in our servers, however, due to the inherent open nature of the Internet, Perfection Learning cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. Users must accept all risks associated with any data transmission, including the risk that their personal information may be intercepted in transit.

California Consumer Rights

If you are a California resident, under the California Consumer Privacy Act of 2018 (“CCPA”), you have specific rights regarding your Personal Information. As used in this section, “Personal Information” has the meaning provided under the CCPA which is information that identifies, relates to, describes, references, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. This section describes the rights that California residents have with respect to “personal information” and explains how to exercise those rights, subject in all cases to any limitations set forth in applicable law.

Please refer to the section(s) entitled “Information That We Collect”, “Information Usage”, and “Special Circumstances for Information Sharing” above for more detail about the types of Personal Information collected, the purposes for which and sources from where we collect Personal Information, and the types of third parties with whom we share Personal Information. We do not “sell” your Personal Information as we understand that term under the CCPA.

Right to Know About Personal Information Collected, Disclosed, or Sold: As a California Consumer, you have the right to request that we disclose certain information to you about our collection, use, disclosure, or sale of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see “Exercising Access and Deletion Rights”), and subject to certain limitations that we describe below, we will disclose such information. You have the right to request any or all of the following:

  • The categories of Personal Information we collected about you.

  • The categories of sources from which the Personal Information is collected.

  • The categories of personal information that the business sold or disclosed for a business purpose about the consumer.

  • Our business or commercial purpose for collecting or selling that Personal Information.

  • The categories of third parties with whom we share that Personal Information.

  • The specific pieces of Personal Information we collected about you.

Deletion Request Rights: You have the right to request that we delete any of your Personal Information that we collected and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see “Exercising Access, Data Portability, and Deletion Rights”), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception (e.g., under applicable law) applies. However, we may retain Personal Information that has been de-identified or aggregated. Furthermore, we may deny your deletion request if retaining the information is necessary for us or our service provider(s) in order to perform certain actions in accordance with applicable laws, such as detecting security incidents and protecting against fraudulent or illegal activity.

Only you, or a person or business entity registered with the California Secretary of State that you authorize to act on your behalf, may make the requests set forth above. The request should include your contact information and describe your request with sufficient detail that allows us to reasonably understand, evaluate, and respond to your request. In addition, you should provide sufficient information that allows us to reasonably verify that you are the person about whom we collected the Personal Information or an authorized representative of that person. For more information about verification, see “Response Timing and Format” immediately below.

Response Timing and Format: We will respond to your request(s) in a reasonably timely manner. If we require extra time to respond, we will inform you of the reason and extension period in writing. In order to protect the security of your Personal Information, we will not honor a request if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. The method used to verify your identity will depend on the type, sensitivity, and value of the information, including the risk of harm to you posed by any authorized access or deletion. Generally speaking, verification will be performed by matching the identifying information provided by you to the Personal Information that we already have.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request (and will not be made more than twice in a 12-month period). If we cannot comply with a request, or cannot fully comply with a request, the response we provide will also explain the reasons we cannot comply.

Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Policy Modifications/Opt-Out

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. However, if at any time in the future we plan to make a material change to the way we use Personal Information under this Privacy Policy, we will provide you with notice of the change and will post an updated Privacy Policy reflecting the change on the Site. If at any time in the future we plan to make non-material changes to this Privacy Policy, we will post such changes here. Your continued use of the Site following the posting of any non-material changes to this Privacy Policy means you accept such changes. Please check this page periodically for any non-material changes to this Privacy Policy.

If you would like to remove Personal Information from our Site, please contact your Teacher or Administrator. We are not responsible for a Teacher or Administrator's failure to remove your Personal Information, including in a timely manner, as that is the responsibility of the applicable School/District.
